Can you cancel a signed Dubai rental contract before handover

Dubai's Rental Disputes Center has ruled that a signed rental contract can be cancelled before handover if deception is proven under the UAE Civil Transactions Law. Either a landlord or a tenant can bring the petition. The case, reported by Gulf News , involved an owner who had agreed to rent a property to a company planning to sublet it. Before handing over the keys, the owner found the company faced court judgments for unpaid rent and previous rental disputes. Its manager was also subject to arrest and bring-in orders tied to bounced cheques. The first instance judges rejected the owner's request to cancel. On appeal, the General Authority of the Rental Disputes Center overturned that and annulled the contract, returning both parties to their positions before signing. Two conditions apply: the handover must not have happened, and deception must be legally established with evidence. A history of past disputes alone does not prove it. Chairman Judge Abdulqader Mousa Mohammed...

What India's foreign asset disclosure rules mean for Dubai property owners

India's Income Tax Department has started contacting selected taxpayers who bought residential or commercial property in the UAE, asking them to confirm the holdings appear in their tax filings, Gulf News reported. The outreach is tied to the Foreign Assets of Small Taxpayers Disclosure Scheme (FAST-DS), which runs until 31 December 2026. About 1,100 applications have been submitted so far. The scheme has two tracks. The first covers undisclosed assets or income up to Rs 10 million, with a 30% tax on fair market value plus an equal additional sum, 60% in total. The second covers previously taxed assets up to Rs 50 million, including purchases made as a non-resident but left off the foreign asset schedule, and can be resolved with a flat Rs 1 million fee. Assets still undisclosed after the scheme closes fall under the Black Money Act of 2015. That means a 30% tax, a Section 41 penalty of three times the tax, and a Rs 10 million penalty under Sections 42 or 43. The Rs 2 million ex...

Dubai approves AED 2 billion urban centres plan: 6 centres, 42 sub-centres and AED 20 billion of property value by 2040

Dubai's Executive Council approved the Urban Centres Development Plan on 27 October 2026 at a meeting held at Emirates Towers and chaired by Sheikh Hamdan bin Mohammed. Sheikh Maktoum bin Mohammed and Sheikh Ahmed bin Mohammed also attended. The plan covers 6 main urban centres and 42 sub-centres, which together make up 12% of Dubai's urban area. Spending is put at more than AED 2 billion. The government expects property in the covered areas to be worth AED 20 billion more by 2040. The Supreme Committee for Urban Planning and Dubai Municipality will run it. Two targets are attached. The share of residents living around metro stations should rise from 52% to 74%, and public service coverage from 74% to 85%. The Council also approved a Sustainable Population Planning Policy and a Digital Authorisation System run by Digital Dubai. The system works through UAE PASS and covers only low-risk services that need no notary. The names of the 6 centres and 42 sub-centres have not been ...

Selling an off-plan Dubai apartment before handover

An investor who bought a two-bedroom, 1,100 square foot apartment at Terra Gardens in Expo City for AED 2,237,000 is weighing a sale before handover, according to an advisory case covered by The National . Completion is scheduled around 2030. The buyer has paid 20 per cent of the price plus the 4 per cent Dubai Land Department fee, which cannot be recovered on resale. Most developers require between 30 per cent and 50 per cent to be paid before issuing a No Objection Certificate for resale. Broker commissions and administrative charges would add to the cost of selling. The unit was bought in February at roughly AED 2,030 per square foot. By late 2026, comparable two-bedroom units in the development were marketed at AED 2,100 to AED 2,200 per square foot, and secondary asking prices ranged between AED 2,090,000 and AED 2,500,000. Dubai names 44 areas where shared housing is allowed: the new building guide, the permits and the deadline owners are already inside

Dubai Municipality has issued its Planning and Building Requirements Guide for Shared Housing and Permitted Areas, which puts Law No. 4 of 2026 into practice. It names 44 areas where a unit may be designated for shared housing. They include Al Ras, Al Dhagaya, Al Buteen, Al Sabkha, Ayal Nasir, Al Murar, Naif, Al Rigga, Al Muteena and Al Muraqqabat. A permit is required before any room is let. It runs for one year and is renewable, an owner may request two years, and renewal must be filed at least 30 days before expiry. The law took effect on 8 September 2026. Owners and managing companies have one year to bring existing shared housing into line, with a single extension possible from the Director General. Fines run from AED 500 to AED 500,000, rising to a ceiling of AED 1 million for a repeat breach wi...

Dubai sets new mooring rules for pleasure boats: Circular No. 35 of 2026 and what a berth is worth

Image
The Dubai Maritime Authority issued Circular No. 35 of 2026 on 13 October 2026. It sets guidelines for leisure anchorage and recreational mooring buoys in Dubai waters, and they apply from the date of the announcement. The authority sits inside the Ports, Customs and Free Zone Corporation. The circular applies to owners of marine craft, operators and their agents, marinas and marine service providers. It requires anchoring only in the designated areas under the published requirements, observance of the collision prevention rules at sea, good seamanship, protection of the marine environment, and immediate reporting of incidents and emergencies. Sheikh Dr. Saeed bin Ahmed bin Khalifa Al Maktoum, chief executive of the authority, said the aim is orderly use of the leisure anchoring areas and one clear rulebook for all users. The authority says it is monitoring compliance rather than waiting for complaints. For buyers of waterfront homes, the type of berth matters: one registered wi...

UAE approves AED 292.5 billion federal budget plan for 2027 to 2029: what AED 90.1 billion in 2027 means for Dubai property

Image
The UAE federal budget for 2027 has been set at AED 90.1 billion, as the first year of a three-year plan worth AED 292.5 billion for 2027 to 2029. The Cabinet approved both on 12 October 2026 under Federal Decree-Law No. 26 of 2019, as amended. Sheikh Mohammed bin Rashid Al Maktoum chaired the meeting. The 2027 allocation is split as follows: social development and pensions AED 34.6 billion (38.4%), government affairs AED 29.1 billion (32.3%), federal expenses AED 17.8 billion (19.7%), financial investments AED 5.6 billion (6.2%), and infrastructure and economic AED 3 billion (3.4%). This is the federal budget, not Dubai's. Registration fees, the 4% transfer charge, Ejari, service charges and the rent index are set by Dubai bodies, which run their own budget cycle. The 2028 and 2029 figures were not broken out, so AED 202.4 billion across those two years has not been allocated publicly. Image
Dubai Finance has put the emirate's cashless transactions index at 90.1%, above the 90% target set for the end of 2026. The figure comes from its final report to the Dubai Strategic Affairs Council. It is built from data supplied by the Central Bank of the UAE, Transguard, payment acquirers, international card networks and Dubai government entities. The programme was launched in October 2024. Dubai government entities received 99.66% of their collections without cash in the first half of 2026. The Digital Enablement Index is at 100%. Dubai Finance counts more than 70 partnerships and puts its strategic accelerators at 95% complete. It scores the three pillars at 97% for governance, 95% for society and 93% for innovation, and credits the work with more than AED 8 billion added to the economy. For property, the payments covered include the 4% transfer fee at Dubai Land Department, Ejari registration and the DEWA deposit. Rent has not changed: tenancies are still usually secured wi...

Dubai's Existing Buildings Greening Guide: what retrofits mean for service charges in older towers

Dubai Municipality's Buildings Regulation and Permits Agency launched the Existing Buildings Greening Guide on 16 September 2026. It is aimed at owners, operators, consultants and investors who already hold buildings, and it lists measures to cut energy and water use, lower carbon emissions, reduce operational waste and improve indoor air and occupant comfort. The guide is not a mandate. No deadline, numerical target or penalty was announced. The municipality calls it a decision-making framework built on economic feasibility. Agency chief executive Maryam Obaid Al Muhairi framed it around lower operating costs as well as lower emissions. Al Sa'fat, the green building system, already applies to new building permits. Service charges Cooling, pumping and common-area lighting drive service charges in jointly owned towers. Towers handed over between 2006 and 2009 are now 17 to 20 years old. Retrofits are paid from the reserve fund or a special levy, so charges may rise for a year...

The Dubai register files a townhouse as a villa, and that is why we will not give you one number for either

Image
Doment has withdrawn the asking-against-recorded percentage from its villa, townhouse and penthouse pages, because the Dubai Land Department register does not tell those homes apart. The register has two residential sub types, Flat and Villa. The first penthouse comparison showed asking prices 159.5 per cent above the recorded median, because penthouses were being measured against every flat in Dubai. Townhouses are filed as villas. In the twelve months to 26 September 2026 the register recorded 13,756 villa sales and 11 Stacked Townhouses sales. On Doment, 5,987 villas are advertised at a mean asking price of AED 15,293,482, and 4,143 townhouses at AED 3,649,749. A villa asks about 4.2 times what a townhouse asks. The percentage stays on the apartment, studio and whole-market pages. Villa pages keep the recorded median, labelled as ready villas and townhouses together, with a note explaining the missing comparison. Read the full article on Doment: The Dubai register files a ...

Dubai apartment prices face downward pressure as incoming supply rises 20 percent

Image
S&P Global expects Dubai's residential stock to grow 20 percent over the next two years, with new deliveries arriving in 2027 and 2028. The rating agency says the added supply, together with regional instability, will likely push apartment prices and transaction volumes lower, Khaleej Times reported. Some segments have already corrected. S&P Global links the first shift to visa reforms that attracted more long-term investors. It assumes regional disruption continues into next year, which could speed adjustments in investor-driven apartment segments. Price declines have stayed moderate in the seven months since the conflict began. Cavendish Maxwell data put third-quarter residential sales at Dh72.6 billion across 34,000 transactions. Sales value fell 47 percent and transactions fell 38 percent year on year. Analysts attribute the drop to the registration lag clearing. Off-plan mortgages introduced earlier this year carry a 50 percent maximum loan-to-value ratio and a...

Why Dubai property sales dropped in the third quarter

Dubai residential property sales fell sharply in the third quarter, according to figures reported by The National . Buyers held back amid regional uncertainty linked to the conflict involving Iran. Home sales totalled Dh72.6 billion in the three months to the end of September, down 47 per cent on the same period a year earlier. Transactions fell 38 per cent to 34,000 homes. Off-plan properties made up 65 per cent of sales value and 72 per cent of purchases. The figures mix recent and earlier activity because of the lag between agreeing a purchase and registering it. For the first nine months, transactions fell 23 per cent to 112,580 and values dropped 27 per cent to Dh292 billion. Dubai Land Department data shows sales averaged 12,644 a month from March to September, down 26 per cent from 17,198 in January and February. Prices fell between 5 per cent and 15 per cent from the end of 2025 through September. S&P Global Ratings expects a gradual correction rather than a rapid colla...
